Agreement
The use of this website and the services provided by Memory Makerz (referred to hereafter as “the Owner”) are governed by the following Terms and Conditions (“Terms of Service”), including all parts incorporated by reference and our Privacy Policy. Please read these Terms carefully before using our website, www.memorymakerz.co.in (“Website”), or our services.
Acceptance
By using this Website, you confirm that you have read, understood, and agreed to abide by these Terms of Service. If you do not agree, please discontinue use of the Website. Access to and use of our Website and Services are granted solely based on your acceptance of these Terms. Additional terms may apply to specific services, forming a separate agreement between you and the Owner.
About the Site
This Website offers wedding photography and related services. We reserve the right to refuse service or limit access to any products listed on the Website at our discretion. We do not screen or censor users who register or access the Website. You assume responsibility for any interactions with other users on the Website, and you agree to use it solely for lawful purposes without impinging on the rights or usage of others.
Photography Service Terms
1. Pricing Validity: Quoted prices are valid for 30 days; booking beyond this timeframe may result in adjusted prices. Special offers will have specific expiration dates.
2. Event Duration: Each session covers up to 6 hours. Extra time will be charged per hour.
3. Changes: Any changes to event dates, venues, outfits, or themes must be communicated in writing at least 15 days before the event. We cannot accommodate requests within the final 15 days.
4. Scope of Services: Memory Makerz will provide photography services as agreed upon in the Client’s booking, contingent on availability. Our team will make every reasonable effort to capture quality images, and the Client agrees to cooperate during the photography session.
5. Travel Expenses: Costs for travel, food, lodging, visa, and location fees outside of Bangalore will be covered by the client or billed as actuals.
6. Copyright & Usage: Memory Makerz retains copyright ownership of all images taken. Clients are granted a personal, non-exclusive license to use the images and may not sell or transfer them to third parties.
7. Force Majeure: Memory Makerz is not responsible for any delay or non-performance resulting from events outside of our control, including natural disasters, war, terrorism, or labor disputes.
8. Notifications: Session reminders will be sent to the Client via WhatsApp or SMS. It is the Client’s responsibility to be reachable on a network or Wi-Fi to receive these notifications.
9. Model Release: The Client grants Memory Makerz permission to use images from their session for promotional purposes, including advertising and display. Clients should secure consent from any individuals featured in the images.
10. Social Media & Display Rights: Memory Makerz may display photos or videos from sessions across social media and other platforms.
11. Raw Data: The Client must provide a 1 TB HDD to receive all raw data.
12. Raw Copies Delivery: Event raw copies will be delivered within 15 days upon receipt of the hard drive.
13. Album Delivery: Albums will be completed approximately 45 days after the Client has selected photos.
14. Revisions: The Production team will conduct two reviews with the Client after the final draft is created.
Intellectual Property
You agree that all content on the Website, including intellectual property such as copyrights, trademarks, patents, and multimedia, is owned by Memory Makerz. You may not reproduce or distribute this content without explicit permission from the Owner.
Indemnification
You agree to indemnify and hold Memory Makerz and its affiliates harmless against any claims, including legal fees, that may arise from your use of the Website, violation of these Terms of Service, or other actions. Memory Makerz reserves the right to select legal representation in such cases.
Payment & Fees
Should you choose to book our paid Services or purchase any products, you agree to pay the specified fees as outlined in your quote. Payment details will be confirmed via email after booking.
1. Payment Terms: 90% of the payment is due 30 days prior to the event. Bookings made within 30 days of an event require immediate payment.
2. Final Payment: The remaining 10% is due upon delivery of raw data.
3. Taxes: Prices do not include GST, which is charged at 18%.
4. Non-Payment: In the event of delayed payment, Memory Makerz reserves the right to suspend work on the event until payment is received.
5. Production Timelines: Full production, photo selection, and editing commence only after receipt of the final 10% payment.
